This agreement is between you and Mark Richmond, a sole proprietor ("we", "us") and covers Porchlight Slideshow and Porchlight Player (together, "the software"). By installing or using the software you agree to it. If you don't agree, don't install or use it.
1. What you may do
Porchlight Slideshow (free). You may download, install and use the free version on any number of computers you own or use, with the limits described on our website and in the app.
Porchlight Slideshow (licensed). When you buy a license, you may use the full version, without those limits, on up to three computers that you own or personally use. The license is for you (or your household); it is not for running a business that makes slideshows for others. It doesn't expire.
Porchlight Player. Porchlight Player is free. You may copy and share it freely, but only unchanged and only as a way to play slideshows, including the copies Porchlight Slideshow puts beside a published slideshow for someone else to play.
2. What you may not do
You may not:
- sell, rent, lend or sublicense Porchlight Slideshow, or share your license key;
- remove or get around the license check or the free version's limits;
- reverse-engineer, decompile or modify the software, except where the law allows it despite this agreement;
- remove our copyright or trademark notices.
3. Your photos, music and slideshows
Your photos, music, words and the slideshows you make are yours. The software works on your own computer; we don't receive or store them (see the Privacy Note).
You're responsible for having the right to use the music, photos and anything else you put in a slideshow, whenever you build, publish, upload, play or share it, including videos made from it. The software doesn't come with any music or any license to use music or photos, and we can't give that permission or advice about it.
4. Ownership
The software is licensed, not sold. We (and our licensors) keep all rights in it, including the Porchlight name and lantern logo. The software includes components from other people under their own licenses; see Credits. Nothing in this agreement limits your rights under those licenses.
5. Updates
We may offer updates. Porchlight Slideshow checks for them when it opens and asks before installing one; Porchlight Player doesn't update itself (download a new copy when you want one). Updates within version 1 are free for license holders; a future major version may be a paid upgrade, and your license keeps working with the versions it covers. We don't have to keep offering updates, or keep supporting older versions.
6. Refunds
Purchases are handled by Lemon Squeezy, who acts as the seller. If the software doesn't work for you, contact us within 7 days of buying it for a refund.
7. No warranty
The software is provided "as is". We work hard to make it reliable, but we don't promise it will be free of errors or work without interruption, and we make no other warranties, to the extent the law allows. Keep your own copies of your photos and music: the software doesn't back them up.
8. Limit of liability
To the extent the law allows, we aren't liable for indirect, incidental or consequential damages, or for lost data, and our total liability is limited to what you paid for the license. Some places don't allow these limits, so they may not apply to you.
9. Ending this agreement
This agreement lasts until it's ended. It ends automatically if you break it; you must then stop using and delete the licensed version. Sections 3, 4, 7 and 8 continue after it ends.
10. General
This agreement is governed by the laws of Oregon, USA. If part of it can't be enforced, the rest still applies. It's the whole agreement about the software between you and us.
